Participant Waiver & Liability Release

Agreement to Participate

This Liability Release and Waiver of Claims (the "Agreement") is entered into by the participant named below and Nerds Giving Tours, LLC (the "Tour Operator").

Acknowledgment of Risks

I acknowledge that I am voluntarily participating in a tour activity organized and operated by Nerds Giving Tours, LLC, and that participation involves inherent and significant risks, including but not limited to:

For Bike Tours

• Falls or collision with objects or vehicles
• Bicycle mechanical failures
• Traffic-related accidents
• Weather exposure (rain, wind, cold, heat)
• Physical exertion and fatigue
• Wet or slippery road conditions
• Reduced visibility in bad weather

For Walking Tours

• Walking on uneven terrain
• Trips or falls
• Weather exposure (rain, wind, cold, heat)
• Physical exertion
• Traffic-related accidents
• Wet or slippery ground conditions

General Risks (All Tours)

• Heat exhaustion or heat stroke
• Dehydration
• Muscle soreness or strain
• Allergic reactions
• Heart attack or other medical emergencies
• Property damage or loss
• Theft of personal belongings
• Exposure to communicable diseases
• Exposure to hazardous weather conditions

Assumption of Risk

I voluntarily assume all risks associated with my participation in this tour activity, whether foreseen or unforeseen. I understand that risks may result in serious injury or death, and I accept these risks.

I acknowledge that:

• I am aware of the risks involved in this activity
• I am in good physical and mental health and am physically capable of participating
• I have disclosed all relevant medical conditions, injuries, or medications to the Tour Operator
• I am not under the influence of alcohol or drugs
• I agree to follow all instructions and safety rules provided by the Tour Operator and guides
• I am responsible for my own physical fitness level and safety

Weather Policy — "Rain or Shine"

I acknowledge and agree to Nerds Giving Tours' "Rain or Shine" weather policy:

• Tours will proceed in rain, wind, cold, and other normal weather conditions
• I accept and assume all risks from weather exposure (rain, cold, heat, wind, sun)
• Tours will be cancelled only if the guide determines conditions are genuinely unsafe (thunderstorms, lightning, flash flooding, extreme heat/cold, high winds, hail, or tornado warnings)
• If the tour proceeds in unfavorable but safe weather: no refund, no rescheduling, no credit

I will dress appropriately for weather, bring rain gear, water, and sunscreen, and follow the guide's weather safety instructions.

Release of Liability

In consideration for being permitted to participate in the tour activity, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby voluntarily release, waive, discharge, and hold harmless Nerds Giving Tours, LLC, its owners, officers, employees, agents, representatives, successors, and assigns ("Released Parties") from any and all claims, demands, causes of action, damages, costs, or expenses arising out of or related to:

• Personal injury or property damage
• Death
• Illness or disease
• Emotional distress or trauma
• Loss or theft of personal belongings
• Any accident or incident during the tour
• Actions or inactions of other tour participants
• Negligence of the Tour Operator or its employees (except gross negligence or willful misconduct)

This release extends to all injuries, damages, or losses that occur before, during, or after the tour activity.

Indemnification

I agree to indemnify and hold harmless the Released Parties from any liability, claims, or damages arising from my violation of this Agreement, violation of any laws or regulations, actions that cause injury to myself or others, property damage caused by my actions or negligence, or failure to follow tour instructions or safety rules.

Medical Authorization

I hereby authorize the Tour Operator and its representatives to seek emergency medical treatment on my behalf if I am unable to do so, contact emergency services if necessary, share my health information with medical professionals in case of emergency, and transport me to a medical facility if necessary. I understand that all costs associated with medical treatment are my responsibility.

Equipment & Physical Condition

For Bike Tours

• I have experience riding bicycles
• I am physically capable of riding for the duration of this tour
• I understand how to properly use bicycle brakes and gears
• I will wear a helmet as required
• I will inform the guide immediately of any bicycle problems

For All Tours

• I am in good physical health
• I have no medical conditions that would prevent safe participation
• I am taking no medications that would impair my ability to participate safely
• I have informed the Tour Operator of any injuries, illnesses, or conditions that could affect my participation

Rules & Conduct

I agree to:

• Follow all instructions and safety rules provided by the Tour Operator and tour guides
• Obey all traffic laws and local ordinances
• Maintain control of my bicycle at all times (bike tours)
• Wear all required safety equipment (helmets for bike tours)
• Stay with the tour group at all times
• Not participate under the influence of alcohol or drugs
• Respect the rights and safety of other tour participants
• Report any injuries, equipment problems, or safety concerns immediately to the guide

I understand that the Tour Operator reserves the right to remove me from the tour without refund if I violate these rules, engage in unsafe behavior, or are under the influence of alcohol or drugs.

Cancellation & Refund Policy

• Cancelled by participant 7+ days before: Full refund
• Cancelled by participant 2–7 days before: 50% refund
• Cancelled by participant less than 48 hours before: No refund
• If Tour Operator cancels: Full refund or free reschedule

Photo/Video Release

The participant will indicate their photo and video consent preferences when signing the physical waiver on the day of the tour.
