1. Agreement to Terms
By booking a tour with Nerds Giving Tours, LLC ("Nerds Giving Tours," "we," "our," or "us"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not book a tour.
These Terms and Conditions apply to all tours offered by Nerds Giving Tours, including Bike Tours (Bring Your Own Bike), Bike Tours (Rental Bikes), Walking Tours, Group Tours, and Private Tours.
2. Booking & Reservation
2.1 How to Book
Tours may be booked through our website at nerdsgivingtours.com or by emailing hello@nerdsgivingtours.com.
2.2 Confirmation
Once you complete the booking form and submit payment, you will receive a confirmation email. This email serves as your booking confirmation and tour receipt.
2.3 Payment
- Payment is due at the time of booking
- All prices are in USD
- Payment is accepted via credit card through Stripe
- All transactions are subject to a 2.9% + $0.30 processing fee
- Prices are final and non-negotiable once booking is confirmed
2.4 Group Bookings
Group rates may be available for 8 or more participants. Group bookings require a designated contact person responsible for payment and communication. The group leader assumes responsibility for all group members.
3. Cancellation & Refund Policy
Full details are available in our Cancellation & Refund Policy. In summary:
- Cancel 7+ days before: Full refund (100%)
- Cancel 2–7 days before: 50% refund
- Cancel less than 48 hours before: No refund
- No-show: No refund
- If we cancel: Full refund or free reschedule
4. Weather Policy
4.1 "Rain or Shine" Tours
Nerds Giving Tours operates on a "Rain or Shine" basis. Tours will proceed in light to moderate rain, wind (under 25 mph), temperatures between 32°F and 95°F, wet pavement, and all other typical weather variations.
4.2 Participant Responsibility for Weather
By booking, you accept that you will get wet and muddy if it rains, you must dress appropriately, and there is no refund or rescheduling due to normal weather. Weather is part of the tour experience.
4.3 Tours Cancelled Only For Unsafe Conditions
Tours will be cancelled with full refunds provided only if conditions are genuinely unsafe: thunderstorms or lightning within 10 miles, heavy rain (>1 inch/hour), flash flooding, extreme heat (>95°F), extreme cold (<32°F), high winds (>25 mph sustained), hail, or official tornado/severe weather alerts.
4.4 Participant's Right to Withdraw
Even if the tour proceeds, if you feel unsafe before the tour starts, you may withdraw for a full refund. No refund is provided once the tour has started.
5. Tour Details & What's Included
5.1 All Tours Include
- Experienced tour guide
- Planned route and tour stops
- Historical and informational commentary
- 2+ hours of guided tour time
- Email confirmation
5.2 What's NOT Included
- Food or beverages (bring your own water)
- Bike helmets (for BYOB tours — participants must provide their own)
- Parking or transportation to meeting point
- Gratuities (tips for guide are optional but appreciated)
- Photos or videos (unless guide takes them upon request)
6. Participant Requirements
6.1 General Requirements
To participate, you must be at least 18 years old (or have parental consent if under 18), be in good physical and mental health, be physically capable of completing the tour, and agree to follow all safety rules and guide instructions. You must also sign the liability waiver before the tour.
6.2 Bike Tour Requirements
Participants must have experience riding bicycles, be able to control a bicycle safely, wear a helmet at all times, and be physically capable of cycling for 2+ hours.
6.3 Walking Tour Requirements
Participants must be physically capable of walking 2–5 miles on potentially uneven terrain.
6.4 Disqualifying Conditions
We reserve the right to deny participation or remove you from a tour if you are under the influence of alcohol or drugs, cannot follow safety instructions, have a medical condition that makes participation unsafe, refuse to sign the liability waiver, or behave unsafely.
7. Participant Conduct & Rules
7.1 Safety Rules
- Follow all guide instructions immediately
- Stay with the tour group at all times
- Wear all required safety equipment (helmets for bike tours)
- Obey all traffic laws, signals, and signs
- Report any equipment problems or safety concerns immediately
- Do not engage in reckless or dangerous behavior
7.2 Behavior Rules
- Be respectful to the guide and other participants
- Do not operate under the influence of alcohol or drugs
- Do not harass or discriminate against other participants or guides
- Do not vandalize, damage property, or trespass
7.3 Consequences of Violation
Participants who violate these rules may be warned, asked to leave the tour, removed from the tour, and/or banned from future tours. You forfeit your tour fee if removed due to a rule violation.
8. Assumption of Risk & Liability
8.1 Inherent Risks
Participants acknowledge that tours involve inherent risks including falls and collisions, traffic accidents, weather exposure, physical exertion, medical emergencies, property damage or loss, and equipment failure. By participating, you assume all risks.
8.2 Liability Release
By booking and participating, you release Nerds Giving Tours from liability for injuries, damages, or losses arising from your participation, except in cases of gross negligence or willful misconduct.
8.3 Medical Care
Nerds Giving Tours is not responsible for medical care. In case of emergency, the guide will call 911, but you are responsible for all medical expenses. You authorize emergency medical treatment by signing this agreement.
8.4 Waiver Requirement
You must sign the Liability Waiver before participation. Failure to sign disqualifies you from the tour.
9. Privacy & Data
Please review our full Privacy Policy for details on how we collect, use, and protect your information. We do not store credit card numbers — all payment data is encrypted and secured by Stripe.
10. Intellectual Property
All content on the Nerds Giving Tours website — including text, images, videos, maps, logos, and branding — is the property of Nerds Giving Tours and protected by copyright law. You may not reproduce, modify, distribute, or use our content for commercial purposes.
11. Limitation of Liability
Nerds Giving Tours' maximum liability is limited to the amount you paid for your tour. We are not liable for loss of income, indirect or consequential damages, personal injuries or property damage, or third-party claims. Tours are provided "as is" without warranties of specific outcomes or experiences.
12. Modifications & Updates
We reserve the right to modify tour routes, times, or stops due to safety, weather, or road conditions with appropriate notice. We may also update these Terms and Conditions at any time — changes become effective upon posting to our website.
13. Dispute Resolution
If you have a dispute, contact us at hello@nerdsgivingtours.com and we will attempt to resolve it within 30 days. If informal resolution fails, disputes will be resolved in DC courts under the laws of the District of Columbia.
14. General Provisions
These Terms and Conditions, along with the Liability Waiver, constitute the entire agreement between you and Nerds Giving Tours. If any provision is found to be invalid, the remaining provisions remain in effect.
